County leases
COUNTIES – Amends existing law to permit county commissioners to enter into a lease for up to 30 years.

This legislation reinstates the maximum duration of county leases for courthouses or jails to 30 years without the requirement of a public election, as was the legal process prior to 2022 and unanimously upheld as constitutional by the Idaho State Supreme Court.
There is no fiscal impact to the General Fund, nor is there a direct increase in local funds (property tax) as a result of this legislation. The bill seeks to alter the terms of county lease agreements, which may impact budget planning for county governments.
