This legislation creates a mechanism whereby the State Legislature can exercise oversight of the Idaho Public Health Districts with regard to informed consent for medical interventions. Informed consent requires that all the available information about the risks and benefits of a medical intervention be given to the patient in a manner that is understandable before initiating the service.
Currently, the risk/benefit analysis is handed down to the local health districts from the U.S. Department of Health & Human Services (HHS) without input from the state or local authorities. This bill mandates that community standards are taken into consideration in the evaluation of the information conveyed to the patient in the act of informed consent.
