This bill limits fund balances for boards and commissions within in the Division of Occupational and Professional Licenses to 125% of the five-year rolling average of annual expenditures. This legislation is necessary to ensure licensees are not being overcharged. Additionally, this bill ensures fund balances for one board are not used for operations for another board or commission. The most recent accountability report performed by Legislative Services Office Audit Division found several boards and commissions had excessive fund balances compared to normal operating cash needs.
This legislation causes no expenditure of funds for state or local governments, nor does it increase or create additional revenues to fund the agency.
