Stockwater forfeiture
WATER – States findings of the Legislature and urges the Governor and the congressional delegation to oppose the federal lawsuit against Idaho’s stockwater forfeiture procedure.

This Memorial recognizes that the United States Department of Justice sued the State of Idaho on June 2, 2022, claiming that the federal government has jurisdiction over Idaho's stockwater. Agriculture and water are of vital importance to Idaho's economy, and Idahoans' very lives. The Memorial requests that the governor enlist every resource to thwart this lawsuit and the attempt to usurp Idaho's sovereign water rights. It calls upon Idaho's congressional officers to request the United States Department of Justice to withdraw its lawsuit against Idaho and take legislative action to protect the state of Idaho's sovereignty and water rights. It also authorizes the Chief Clerk of the House of Representatives to forward a copy of this Memorial to the President of the Senate and Speaker of the House of Representatives of Congress, as well as Idaho's congressional delegation.

This legislation causes no additional expenditure of funds at the state or local level of government nor does it cause an increase or decrease in revenue for state or local government. Therefore, the legislation has not fiscal impact.
