Abortion, pregnant minors
ABORTION – Amends existing law to prohibit the recruiting, harboring, or transporting of a pregnant minor to procure an abortion and to provide certain requirements and restrictions on a civil action.

RS30171 / H0098

This legislation amends sections in the chapter of Idaho Code related to human trafficking by adding definitions related to the illegal trafficking of minors to procure a criminal abortion. The legislation also amends the section of Idaho Code dealing with criminal abortion by prohibiting anyone from trafficking a minor for a criminal abortion with the intent of concealing the crime from the minor's parents. This legislation also authorizes the State Attorney General to prosecute at his or her discretion for a crime committed under the section governing criminal abortions. This legislation also provides for civil remedies.

There should be no impact to the General Fund. Should the State Attorney General's office pursue prosecutions, they are currently funded.
