Criminal abortions, exceptions
CRIMES – Amends existing law to revise the definition of “abortion” and to provide that certain actions and attempts shall not be considered criminal abortions.

This legislation provides clarification to the 2020 “Trigger Law” (IC 18-622). It codifies various findings of the Idaho Supreme Court from the Planned Parenthood et. al. vs. Idaho case decided on January 5, 2023. It changes the affirmative defense structure of the law into an objective standard with specific exceptions to the general ban on abortion in Idaho Code. And it guarantees that victims are entitled to receive copies of their complaint in a timely manner.
There will be no impact to the state general fund.
