MUNICIPAL CORPORATIONS – Amends existing law to provide that certain notice may be given by first class or certified mail and to provide for proof of mailing.

This Legislation amends Idaho Code Section 50-1306A, Vacation of Plats, adding language to allow a municipality to provide certain notices through first class mail, certified mail, or certified mail return receipt. In addition, a new section is added to require the sender of such notice to retain a proof of mailing of such notice, to be produced upon request. This legislation may reduce the cost of mailing notices by certified mail return receipt, as this cost is solely borne by the citizen filing the petition to vacate. Many individuals are now refusing to pick up or accept a certified letter causing undo expenses to our citizens.

There is no fiscal impact to the State’s General fund or any dedicated fund as the costs of mailing a municipal notice is paid by the applicant petitioning to vacate the property.
