HOUSE CONCURRENT RESOLUTION 26

This concurrent resolution declares that the State Board of Education has acted beyond the scope of its legal authority in attempting to affiliate the University of Idaho with the University of Phoenix. The resolution further declares that the Board has infringed on the Legislature’s power in violation of the Idaho Constitution.
The resolution: 1) calls for the proposed affiliation to be considered by the Legislature; 2) requests that the Board reconsider its vote authorizing the creation of a corporation; 3) requests that the Board, the University of Idaho, and the University of Phoenix cooperate fully with the Legislature while the Legislature considers the proposed affiliation; and 4) authorizes the Speaker of the House of Representatives and the President Pro Tempore of the Senate to act as agents of the Legislature in taking certain actions, including potential legal action.
