Raw milk
RAW MILK – Amends existing law to revise provisions regarding raw milk and raw milk products.

This legislation amends Section 37-1101 related to raw milk production and sales in Idaho. When the code section was added in 2010, it contemplated that the primary means of raw milk sales would be by herd share, but it also provided a permitting mechanism. Since its implementation, 100% of the raw milk production and sales have transitioned to the permitting system, and there have been no herd share registrations for many years. This legislation eliminates many of the herd share details for raw milk, which allows the Department of Agriculture flexibility to adjust those in rule making. Some of the requirements are also already covered by other sections of Idaho Code. This legislation retains raw milk permitting and breaks out the enforcement mechanism to the new section 37-1102.

There is no fiscal impact to the general fund or local governments because this legislation does not change the current opportunities and requirements for the production and sale of raw milk in Idaho.
