DEVELOPMENT IMPACT FEES – Amends existing law to provide for the use of development impact fees for public school facilities.

This bill adds public schools to the list of public facilities and school districts to the list of government entities allowed to use the statutory development impact fee mechanism to fund capital improvements attributable to new growth and development. The Local Land Use Planning Act identifies and specifically names school districts as governmental entities to be notified or considered in mitigating development impacts in at least four sections. To achieve consistency and uniformity in addressing and mitigating the effects of new growth and development, adding school districts to the development impact fee code accomplishes the intent contemplated in the local land use planning act and places statutory limits on the amount of school impact mitigation a local jurisdiction can exact from new development.

There is no expected impact to the general fund.
